Notice at Collection and Privacy Policy for California Employees and Applicants

Introduction

This Notice at Collection and Privacy Policy for California Employees and Applicants (“Notice”) applies solely to all Holland, L.P. (“Holland”, “we”, “us”, “our”) employees, job applicants, independent contractors, or similar individuals who reside in the State of California (“you”, “your”). We adopt this Notice to comply with the California Consumer Privacy Act of 2018, as amended (“CCPA”). Any terms defined in the CCPA have the same meaning when used in this Notice.

This Notice describes the categories of personal information that may be collected by Holland in various human resources (“HR”) contexts, and the purposes for which such information may be collected and used. It also describes the categories of such information collected by Holland during the preceding 12 months. Finally, it describes your rights under the CCPA concerning your personal information.

This Notice does not apply to our data privacy practices outside of the HR context. Please see our Privacy Policy (available at: www.hollandco.com) for information concerning Holland’s data privacy practices in the customer or business-to-business context.

Definition of Personal Information

 

Personal information means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information does not include (i) publicly available information, or (ii) consumer information that is deidentified or aggregate consumer information.

Categories of Personal Information We Collect

We may collect the following categories of personal information when you apply for a job with Holland or during the course of your employment with Holland:

  • Identifiers and Contact Information. This category includes names, addresses, telephone numbers, mobile numbers, email addresses, dates of birth, Social Security numbers, driver’s license or state identification numbers, bank account information, dependent and beneficiary information (names, dates of birth, Social Security numbers) and other similar contact information and identifiers.
  • Protected Classification Information. This category includes characteristics of protected classifications under California or federal law, such as gender and ethnicity.

Please Note: Holland collects this information on a purely voluntary basis except where collection is required by law and uses such information only in compliance with applicable laws and regulations.

  • Internet or Other Electronic Network Activity Information. This category includes all activity on the Company’s information systems, such as internet browsing history, search history, intranet activity, email communications, social media postings, stored documents, and usernames/passwords. It also includes all activity on Company communications systems and Company-issued devices, such as phone calls, call logs, voicemails, text messages, chat logs, app use, mobile browsing and search history, and mobile email communications.
  • Geolocation Data. This category includes GPS location data from Company-issued mobile devices and Company-owned vehicles.
  • Audio, Electronic, Visual, Thermal, Olfactory, or Similar Information. This category includes information collected from cameras, microphones, and similar devices.
  • Professional or Employment-Related Information. This category includes data submitted with employment applications such as employment history and references; background check and criminal history; motor vehicle records; work authorization; professional licenses; educational degrees; fitness for duty data and reports; performance and disciplinary records; salary and compensation data; benefit plan enrollment, participation, and claims information; and leave of absence information.
  • Education Information. This category includes education history.
  • Inferences Drawn from Personal Information. This category includes profiles derived from personal information reflecting a person’s preferences, characteristics, behavior, attitudes, intelligence, abilities, and aptitudes.
  • Personal Information Defined as “Sensitive” under the CCPA. This category includes (i) social security, driver’s license, state identification card, and passport numbers; (ii) account log-in and financial account numbers in combination with any required security or access code, password, or credentials allowing access to an account; (iii) precise geolocation; (iv) racial or ethnic origin, religious or philosophical beliefs; (v) contents of communications unless Holland is the intended recipient of the communication; and (vi) information concerning health.

Please Note: Holland collects subcategories (iv) and (vi) information on a purely voluntary basis except where collection is required by law and uses such information only in compliance with applicable laws and regulations.

  

Purposes for Which the Above Categories of Personal Information are Collected or Used

We collect and use personal information for the following purposes:

  • To manage the application and hiring process, including processing employment applications, evaluating an individual’s qualifications for employment, confirming eligibility for employment, background and related checks, onboarding, and related recruiting efforts;
  • To communicate with you, your emergency contacts and plan beneficiaries;
  • To administer your employment relationship with us, including timekeeping, payroll, expense reimbursement, benefits enrollment/administration, and leave of absence administration;
  • Performance management, including performance reviews, promotions, and discipline;
  • To ensure compliance with Company policies and procedures, and investigate complaints and suspected violations of such policies;
  • Manage and monitor employee access to Company facilities, equipment, and systems;
  • Ensure and enhance employee productivity;
  • Education, training, and professional development;
  • To comply with applicable legally required or industry standard business/employment record keeping requirements;
  • Compliance with applicable laws and regulations, including state and federal health, safety, labor, employment, workers’ compensation, disability, and equal employment opportunity requirements;
  • To improve safety of employees, customers, and the public with respect to the use of Company property and equipment;
  • To protect our legal rights, bring/defend a claim or lawsuit, and investigate or prevent actual or suspected loss or harm to persons or property;
  • To cooperate with law enforcement or other government entities, as required by law; and
  • Merger and acquisition activities.

Holland does not sell or share your personal information within the meaning of the CCPA. We also do not use or disclose your sensitive personal information for purposes other than those allowed by the CCPA and its regulations. Further, Holland does not collect or process sensitive personal information for the purpose of inferring characteristics about you.  

We will not collect additional categories of personal information or use personal information collected for additional purposes that are incompatible with the purposes outlined in this Notice without first providing you with notice as required by law. We will retain personal information about you for as long as necessary to fulfill the purposes outlined in this Notice. Where required by applicable law, we will delete your personal information when you request us to do so.

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from you; for example, from forms you complete or from documents you voluntarily provide to us such as your resume.
  • Indirectly from you; for example, from your use of Company equipment and systems.
  • From third parties; for example, from recruiting or executive search agencies, background check vendors, references, former employers, and other employees.

We may disclose your personal information to the following parties as necessary to carry out the purposes described in this Notice: (i) Holland Affiliates; (ii) Service Providers (including, but not limited to, background check vendors, payroll processors, benefits providers, IT service providers, attorneys, and accountants); (iii) Government or Law Enforcement Entities; (iv) Transaction Participants (in connection with the sale or transfer of all or a portion of our business or assets to a third party); and (v) Legal/Compliance Related Recipients (for the purposes of fulfilling our legal obligations under applicable law, regulation, court order or other legal process).

 

Your Rights

  1. Right to Know: You have the right to request that we disclose:
  1. The categories of personal information we have collected about you.
  2. The categories of sources from which the personal information is collected.
  3. Our business or commercial purpose for collecting the personal information.
  4. The categories of third parties to whom we disclose personal information.
  5. The categories of personal information we have sold, shared, or disclosed for a business purpose.
  6. The specific pieces of personal information we have collected about you.
  1. Right to Correction: You have the right to request that we correct any inaccurate personal information, taking into account the nature of the personal information and the purposes of the processing of the personal information.
  2. Right to Delete: You have the right to request that we delete any of the personal information we collected from you, subject to the exceptions set forth in the CCPA (California Civil Code § 1798.105(d)). These exceptions include instances where it is necessary for us to retain your personal information in order to comply with our legal obligations, or where deleting the data would prevent us from exercising or defending legal claims.
  3. Right of No Retaliation: Holland will not discriminate against any individual who exercises any of the privacy rights conferred by the CCPA.

How to Exercise Your Rights

Your request should include your name, contact information (i.e., mailing address, phone number, email address), and relationship to Holland (i.e., applicant, employee, former employee). After you submit your request, we will take steps to verify your identity to ensure that you are the individual about whom Holland has collected information. We will attempt to verify your identity by matching the pieces of personal information you provided with the personal information maintained by Holland. If we are unable to verify your identity, we may contact you for additional information. If we are ultimately unable to verify your identity, we will inform you of such and your request will be denied.

You can designate an authorized agent to make a CCPA request on your behalf if the authorized agent is a natural person or a business entity registered with the California Secretary of State to conduct business in California. To make a request on your behalf, the authorized agent must first provide a copy of either: (1) a written statement signed by you authorizing such agent to submit a request on your behalf; or (2) a valid power of attorney issued pursuant to California Probate Code sections 4121 to 4130. Prior to fulfilling a CCPA request submitted by your authorized agent, we may require you to verify your own identity and/or directly confirm that you provided the authorized agent with permission to submit a request on your behalf.

In most cases, we will respond to your request to delete, request to correct, and request to know within 45 days. If additional time is needed to respond to your request, we will notify you within 45 days.

Changes to this Notice

We reserve the right to amend this Notice at any time, without advance notice. When we do so, we will post the new Notice and update the effective and last updated date above.
